Per Curiam. In this original proceeding, the petitioner State of Hawaii (the prosecution) petitions this court to issue a writ of mandamus and/or prohibition directing the respondent Judge Ruby A. Hamili (the respondent Judge), District Judge of the Second Circuit, to vacate her order granting the defendant-respondent Wilfredo Felixs deferred acceptance of no contest plea (DANC plea), and ordering the respondent Judge to resentence Felix in accordance with Hawaii Revised Statute (HRS) § 188-70 (1993).
