Description

The opinion of the court was delivered by Defendant-appellant, Danny Ray Lamb, appeals from convictions by a jury of the offenses of aggravated robbery (K.S.A. 1973 Supp. 21-3427) and kidnapping (K.S.A. 1973 Supp. 21-3420). The victim of both offenses was Norman Schaefer, a resident of Coffeyville. The state's evidence consisted primarily of the eyewitness testimony of Schaefer and that of three cohorts of defendant who were with him in the late hours of the evening of November 18, 1972, and early morning hours of November 19, when the offenses against Schaefer were perpetrated. The three companions of defendant were William James Lanham, Leroy Weber and Vernon Lee Frakes, each of whom was convicted on a plea of guilty prior to the trial of defendant.
