Michael John Paul Keeley ("Appellant") appeals from his conviction for possession of marijuana and possession of drug paraphernalia, each a class six felony with two prior felony convictions. The sole issue is whether Appellants motion for mistrial should have been granted after the deputy county attorney elicited testimony from the arresting officer that Appellant invoked his right to remain silent when asked a post-arrest question he did not want to answer. We conclude that the State deliberately created constitutional error and that a new trial is warranted.
